Tenancy Changeover

Your tenancy is Joint and Several which means that any tenant may give notice on their tenancy and it applies to all tenants. 

Where one or more of the current tenants wish to leave the property but other tenant/s want to remain we call this a Tenancy Changeover. Your landlord may allow a tenancy changeover. 

Three Parties to the Tenancy Changeover

This assumes that a outgoing tenant is being replaced. The same steps take place where there is not incoming tenant.

Remaining Tenant/s

This is the tenant who is remaining in the property and whose responsibility will remain on a joint and several basis.

Outgoing Tenant/s

This is the tenant whose responsibilities will end on the changeover date. Prior to this date, a fair and reasonable amount should be considered towards damages and cleaning, agreed between tenants.

Incoming Tenant/s

This is the tenant who will assume responsibility for the property from the original tenancy start date and therefore should consider the condition of the property upon move in.

Notification of Tenancy Changeover

We require written notification (if can be done below) or else an email sent to notices@ezytrac.uk as per your AST agreement. In this notification we need to know if the tenancy is being brought to an end, if so which date, or if a tenant is to be found to replace existing tenant. 

Approval of a tenancy changeover is the discretion of the landlord.

Application/ Reapplication & Fee Payment

The Tenant Fee Ban allows us to charge £50 fee to arrange the changeover. This will need to be paid to cover the costs of referencing and reissuing documents.

Referencing of All Remaining and Incoming Tenants

All remaining and incoming tenants will be required to undergo referencing, this allows for your landlord to have peace of mind and also allows for Rent & Legal Insurance should the landlord have it. Please note that remaining tenants must undertake this again otherwise we cannot arrange the changeover.

Deposit Refund, Payment & Registration

Ezytrac will handle all payments/repayments of deposit between tenants and the if required the Deposit scheme will handle any disputes between the tenants.

Inventory Considerations

IMPORTANT - If the tenancy is continuing:


The incoming tenant will be responsible for the condition of the property since the original move in date (We will send you the original check in report) and not the date they move into the property.


Parties will be provided with the Original Check In, The remaining, incoming and outgoing tenants will need agree between themselves a fair outcome for the outgoing tenants damages beyond fair wear and tear. The outgoing tenant will pay the incoming tenant the agree amount of damages and the incoming tenant will pay their full share of the deposit and will then become liable for all damages from the original tenancy move in date.

Key Handover and Changeover date

On or before the designated changeover date tenant will arrange handover of keys and the incoming tenant will become joint and severally liable for the rent and property.

Tenant Fees Act 2019

A payment in respect of the ‘variation, assignment or novation of a tenancy’ at the tenant request is a permitted payment under the Tenant Fees Act 2019[para 6, Sch.1]. This could, for example, include agreeing to a your request to assign a tenancy following a relationship breakdown, changeover from one tenant to a new tenant.

Novation occurs where all the parties consent to creating a new agreement. This could happen, for example, where one joint tenant wishes to leave and the landlord agrees for them to find someone to ‘take over’. If all joint tenants (including the leaving tenant) and the landlord agree, a new contract could be created and the original joint tenancy would be in effect surrendered by operation of law.

The tenant changeover fee is generally capped at £50. Charging more than £50 for each change requested is not permitted, unless the reasonable costs are greater, if this is the case we will provide a receipt for additional costs.
